The following brief notes are intended to shed some light on the obligations of proof which the guarantor must bear in court in order to have the antitrust nullity action accepted.

More precisely, the evidence to be provided differs depending on whether the contested guarantee precedes the 2005 bank of Italy order or is subsequent to the order.

The judgment of the unified sections of the court of cassation of 30 December 21 leaves these aspects open, which must be resolved by the interpreter of the law.
